MANAGING PROPERTY POSSESSION PROBLEMS WITH BUILDERS

Booking a property with a builder has its own share of anxieties and confusions. Toronto based Rohan Pandey was witness to something similar when his mother passed away and he found himself listed as a nominee in a group housing membership that she had in her name. Based in Gurgaon, near Delhi this society was supposed to have provision for a reasonably sized property with all basic amenities as part of the deal. Subsequently, he set about taking care of all pending payments. Meticulous to the core, he made all payments on time through proper channels and duly kept proof of the transactions too. Initially he was assured by the builders of a good sized piece of land. Gradually they shifted gear to provision of an apartment. In time, the commitment on that too seemed to waver with Rohan being given meaningless stories about some discrepancy in his nomination. Completely at a loss with the way things seemed to be working out, Rohan contacted the Toronto office of this company and sought relief. He was determined that his name now be included in the documents and his rights be preserved and protected as far as the property ownership was concerned. Various visits to India did not prove to be of any help and he could not even manage to gather basic documentary proof to stake his claim. On top of that the Builder company offered no support in the process-instead Rohan was made to feel that he was encroaching upon territory not supposed to be in his domain at all.  Once the legal team came into the picture various discussions were carried out by the lawyers so that Rohan could explain the entire problem to them and share whatever documentary proof he had. During this process, the biggest relief for Rohan was that he didn’t have to travel back and forth to India. Updates were given to him on a regular basis through the efficient communication system – mails, video talks, frequent messages all added to the clarity needed in the understanding of the case. A basic transparency in the working style of the company was a boon to Rohan while he strove to assert his claim to the property.  There are various cases where trusting NRI clients suffer at the hands of builders while investing in property. Rohan was proved to be right and his organized documentation helped him reach his destination sooner than expected. All it takes is timely action and agility in context of the paper work. Even if there is a slight hitch in these, rest assured that the company strives to get its clients their due rights assigned with a resourceful team, diligent communication and humane approach.
